Legal Action

In the event our collection strategies fail to get a speedy result, we may recommend pursuing the matter via litigation. We micromanage any debt claim from pre-action letters and commencement of a legal claim, to enforcement of the subsequent Court judgment. All through this process we maintain a positive dialogue with the debtor to allow the prospect of recouping the debt and negotiate an early settlement.


Legal Action will only ever commence with prior written authority from you, the client. Recoup will never start the litigation process without first providing you with a strategic recommendation, an estimate on costs, and an expert opinion from counsel.

Enforcing a Judgment 

Recoup will manage your case(s) from pre-action letters and commencement of a legal claim, to enforcement of the subsequent Court judgment or arbitration award.  Once Judgment has been obtained and if the client has still not been paid, the next step will be to enforce this Judgment. There are various ways to enforce a Judgement and Recoup will work with you to establish which will be most effective for your situation.


For most legal action is often seen as the final step in the debt recovery process, but ask any company that has ever secured a Court Judgment against one of their customers and they will tell you that this is often not the case.


A Judgment is simply a piece of paper unless the correct enforcement action is taken.  All through our instruction we will monitor and profile your debtor, keeping any eye on their financial circumstances to ascertain the appropriate method of enforcement.
